1. Green Card New York Employment Based Immigration Background

Prior Eb-3 Immigrant Petition Approval


The beneficiary had previously obtained approval of an EB-3 immigrant petition as a Budget Operations Analyst employed by a mid sized financial services organization headquartered in Manhattan. 

 

The position required specialized analytical skills, budget forecasting responsibilities, and regulatory reporting duties that met the professional classification requirements under federal immigration standards. 

 

The employer demonstrated the ability to pay the proffered wage and maintained compliance with New York State wage payment laws during the entire immigrant visa process.



2. Green Card New York I-485 Filing Strategy and Legal Framework


Following the approval of the immigrant petition, the applicant became eligible to file Form I-485 to adjust status to that of a lawful permanent resident, commonly referred to as obtaining a green card. The adjustment application was prepared in accordance with INA §245 and 8 C.F.R. §245.1, with careful attention to maintaining continuous lawful status while residing and working in New York.


Adjustment of Status without Uscis Interview

4. Green Card New York Approval Outcome and Permanent Residence


USCIS approved the I-485 Adjustment of Status application without issuing a Request for Evidence and without requiring an interview, confirming the applicant’s eligibility for lawful permanent residence. Shortly thereafter, the applicant received the physical green card, formally completing the transition from nonimmigrant status to permanent resident.
