1. O & P Visas for Individuals with Extraordinary Ability

The O visa is a non-immigrant, employment-based visa granted to individuals who possess “extraordinary ability” in sciences, education, business, athletics, or the arts, evidenced by sustained national or international acclaim. The O-1 visa requires a U.S. employer or agent to file a petition supported by a contract, itinerary, and evidence of the applicant’s achievements.

O & P Visas: Eligibility and Supporting Documentation

Unless the applicant has received a major international award, at least three forms of evidence must be submitted. These may include published materials, expert letters, or proof of commercial success. Advisory opinions from peer organizations are also required. Initial admission is granted for up to three years and can be extended as needed.

2. O & P Visas for Support Personnel: The O-2 Category

O-2 visas are granted to essential support staff of O-1 visa holders. To qualify, the O-2 applicant must demonstrate a critical skill or long-standing relationship with the O-1 beneficiary and will be granted the same period of stay as the principal.

O & P Visas: Dependents of O-1 and O-2 Visa Holders

Spouses and unmarried children under 21 of O visa holders may apply for O-3 dependent visas. While they cannot work in the U.S., they may study during their stay.

3. O & P Visas for Internationally Recognized Athletes

The P-1A visa is available to individual athletes or athletic teams that have achieved international recognition. Eligible applicants must be coming to the U.S. to participate in specific, distinguished competitions. Athletes in sports such as soccer, basketball, tennis, esports, and more may qualify.

O & P Visas: Eligibility for Professional Leagues and Major Events

Applicants must show that the competition or league is of international stature. This includes athletes in major sports leagues or representing national teams. Documentation should include rankings, contracts, and media coverage.

4. O & P Visas for Entertainers, Cultural Artists, and Support Staff

P-1B visas are for members of internationally recognized entertainment groups. P-2 and P-3 visas are for artists and entertainers participating in exchange programs or culturally unique events. P-1S visas are designated for essential support staff of P-1A athletes.

Our firm supports clients through all stages: evidence collection, advisory letters, petition filing, and interview preparation. We tailor our support to the unique needs of athletes, musicians, and performers to ensure full legal compliance.
