1. Asylum Eligibility and Grounds for Protection

To qualify for asylum, an applicant must demonstrate a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. The fear must be credible and tied to government action—or inaction in controlling persecutory groups.

Asylum Based on Past Persecution or Future Fear

Applicants can qualify by showing either past persecution or a credible fear of future persecution. Each case requires substantial documentation, including witness statements, medical records, and country condition reports.

2. Asylum Filing Deadlines and Exceptions

Generally, asylum applications must be filed within one year of arrival in the U.S. If an applicant overstays a visa, they must apply within a reasonable period—usually within six months of expiration. Exceptions exist, including extraordinary circumstances or changes in home country conditions.

Asylum Alternatives: Withholding of Removal and CAT Protection

If the one-year deadline cannot be met, applicants may pursue withholding of removal or relief under the Convention Against Torture (CAT). These options require a higher burden of proof and demonstrate that deportation would lead to persecution or torture.

3. Asylum Representation in Appeals and High-Risk Cases

SJKP LLP offers strong representation in complex asylum appeals before the Board of Immigration Appeals and U.S. federal courts. We handle politically sensitive and classified cases with the utmost discretion and skill, often representing individuals with national security concerns.

Asylum Legal Support with Compassion and Precision

We understand the emotional and legal complexity of asylum cases. Our firm offers empathetic, client-centered support while maintaining the rigorous legal standards necessary to secure protection.
